These terms are a binding agreement between you and Growth BLDR, LLC that governs your use of this website and any request you submit through it. By using the site or submitting a request, you accept these terms. If you do not agree, do not use the site.
About this service
New Braunfels RV Repair is a brand operated by Growth BLDR, LLC. Growth BLDR, LLC is a referral service. It connects customers with independent local RV service professionals. Growth BLDR, LLC does not perform RV repairs, does not employ the providers, and is not a party to any agreement between you and a provider.
Independent providers
Independent local service professionals quote, contract for, perform, warrant, and collect payment for all work. Pricing, scheduling, workmanship, parts, warranties, licensing, and insurance are the responsibility of the provider, not Growth BLDR, LLC. You are responsible for reviewing and choosing any provider before you hire them. We do not claim that providers are vetted, licensed, insured, or certified unless a specific claim is stated and verified.
No service contract with us
Submitting a request or calling a number on this site does not create a service contract with Growth BLDR, LLC or with any provider. Any agreement for work is solely between you and the independent provider you choose. Arrival windows or estimates you receive are made by the provider in good faith and are not guaranteed by Growth BLDR, LLC.
Referral compensation
Growth BLDR, LLC may receive a fee or other compensation from providers for referrals or leads. This does not add to the price a provider quotes you unless the provider states otherwise.
Independent providers are not our agents
The providers are independent contractors. Nothing on this site or in these terms creates an agency, partnership, joint venture, franchise, or employment relationship between Growth BLDR, LLC and any provider. Providers do not act for Growth BLDR, LLC and cannot bind Growth BLDR, LLC. Growth BLDR, LLC does not supervise, direct, or control how a provider performs work, and is not responsible for a provider's acts, omissions, conduct, pricing, or the quality or safety of their work.
Your responsibility and assumption of risk
You are responsible for evaluating, selecting, and dealing with any provider, and for confirming their licensing, insurance, pricing, and suitability before you hire them. Any work is done at your own risk and under your agreement with the provider. To the fullest extent allowed by law, you release Growth BLDR, LLC and its owners, members, officers, and agents from all claims, demands, and damages arising out of or related to any provider, any referral, or any work performed.
No warranty
The site and the referral service are provided "as is" and "as available." To the fullest extent allowed by law, Growth BLDR, LLC makes no warranty about any provider, their availability, pricing, workmanship, licensing, or insurance, and disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Any warranty on repair work comes from the provider, not Growth BLDR, LLC.
Limitation of liability
To the fullest extent allowed by law, Growth BLDR, LLC and its owners, members, officers, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, personal injury, or property damage, arising out of or related to the site, a referral, or any provider's work, even if advised of the possibility. Growth BLDR, LLC's total liability for any claim relating to the site or the referral service will not exceed one hundred U.S. dollars ($100). Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
Indemnification
You agree to defend, indemnify, and hold harmless Growth BLDR, LLC and its owners, members, officers, and agents from any claims, damages, losses, and costs (including reasonable attorneys' fees) arising out of your use of the site, your dealings or agreements with any provider, or your violation of these terms.
Dispute resolution and arbitration
Please read this section carefully; it affects your legal rights. You and Growth BLDR, LLC agree that any dispute arising out of or relating to the site or the referral service will be resolved by binding individual arbitration administered under the rules of a recognized arbitration provider, seated in Texas, rather than in court, except that either party may bring a claim in small-claims court. You and Growth BLDR, LLC waive any right to a jury trial and agree that claims may be brought only in an individual capacity, and not as a plaintiff or class member in any class or representative proceeding. If this class-action waiver is found unenforceable, the rest of this section still applies. Disputes with a provider are between you and that provider, not Growth BLDR, LLC.

These terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules. Any dispute will be handled in the state or federal courts located in Texas.
Changes to these terms
We may update these terms from time to time. Your continued use of the site means you accept the current version.
Severability and entire agreement
If any part of these terms is found unenforceable, the rest stays in effect. These terms, together with the Privacy Policy, are the entire agreement between you and Growth BLDR, LLC about the site and the referral service. Our failure to enforce any provision is not a waiver of it.
